User Agreement and Pilot Consent

IMPORTANT: PLEASE READ CAREFULLY. THIS AGREEMENT CONTAINS A MANDATORY ARBITRATION PROVISION AND CLASS ACTION WAIVER.

By clicking “I Agree” or by accessing or using Lingwell, you enter into a legally binding agreement with Center for Linguistic Health LLC. If you do not agree, do not use Lingwell.

1. Nature of the Service

Lingwell is an AI-guided reflective writing tool currently offered in pilot form. It is designed for structured self-expression and personal reflection. It is not medical care, psychotherapy, psychiatric treatment, crisis intervention, or a substitute for professional diagnosis or treatment.

2. AI-Generated Content

Lingwell generates responses through automated artificial intelligence systems. Responses are algorithmically generated, not reviewed in real time by licensed professionals, and may be inaccurate or incomplete. Outputs are not medical or psychological advice.

3. No Duty to Monitor or Intervene

Lingwell does not monitor user activity in real time and has no obligation to monitor, respond to, or intervene in situations involving distress, self-harm, or emergency circumstances.

4. Crisis Use Limitation

Lingwell is not designed to identify or respond to mental health crises. If you are in crisis, call 911 or the 988 Suicide and Crisis Lifeline immediately.

5. Eligibility

You must be at least 18 years of age to use Lingwell.

6. Pilot Participation

Lingwell is currently in a pilot phase. Participation is voluntary. You may discontinue use at any time.

7. Information We Collect

• Text you enter
• Lingwell-generated responses
• Timestamps and session duration
• Device, browser, IP address, and technical metadata
• Optional feedback

8. Use of Information

We use collected information to operate and maintain the service, improve system clarity and usability, and conduct internal analytics. We do not use identifiable personal content for advertising, resale, or training publicly available AI models.

9. User Content and License

You retain ownership of content you submit. By using Lingwell, you grant Center for Linguistic Health LLC a non-exclusive license to use, process, and analyze your content solely for operating and improving the service.

10. Health Information Disclaimer

Lingwell is not intended for the storage or transmission of protected health information unless expressly agreed to in a separate written agreement.

11. Data Security and Retention

We implement commercially reasonable safeguards including encryption and access controls. You may request deletion of identifiable data through the website.

12. Assumption of Risk

You acknowledge that engaging in written reflection may involve discomfort or unintended emotional responses. You voluntarily assume all risks associated with your use of Lingwell.

13. Disclaimer of Warranties

Lingwell is provided on an “as is” and “as available” basis. No guarantee is made regarding outcomes, emotional benefit, or personal improvement.

14. Limitation of Liability

To the fullest extent permitted by law, Center for Linguistic Health LLC shall not be liable for any indirect, incidental, or consequential damages. Total liability shall not exceed $100 or the total amount paid in the twelve months preceding the claim.

15. Governing Law & Arbitration

This Agreement is governed by the laws of the State of Tennessee. Any dispute shall be resolved through binding arbitration in Tennessee on an individual basis.

16. Updates

We may update this Agreement from time to time. Continued use of Lingwell after updates constitutes acceptance of revised terms.
